LEGAL NOTICE & TERMS AND CONDITIONS OF SERVICE

1. BINDING EFFECTThese Legal Notice, Terms & Conditions (“Terms”) govern all services provided by Safety & Security (“the Company”, “we”, “us”, “our”).These Terms apply to all:

•    Quotations•    Installations•    Repairs•    Call-outs•    Maintenance plans•    Inspections•    Equipment supply•    Solar panel cleaning•    Automation and security services
By:•    Accepting a quotation•    Making payment•    Booking a service•    Allowing work to commence•    Signing any maintenance agreement
The Client confirms that they:•    Have read these Terms•    Understand them•    Agree to be legally bound by them

These Terms are incorporated into all contracts and agreements as if fully written therein.

2. SCOPE OF SERVICES

Services are strictly limited to the scope described in the accepted quotation or maintenance plan.Any variation, additional work, upgrade, modification, or unforeseen requirement shall be quoted and charged separately.

3. SITE ACCESS & CLIENT RESPONSIBILITIESThe Client must:•    Provide unrestricted and safe access to the site•    Ensure technicians can work without obstruction•    Disclose structural, electrical, or environmental hazards•    Secure aggressive animals before arrival

Failure to provide safe and accessible working conditions may result in:•    Immediate suspension of work•    Additional call-out charges•    Rescheduling fees

4. WORKING AT HEIGHTS & ROOF ACCESSWhere work is performed at heights (including roofs, ladders, elevated structures, or platforms), the Company will conduct risk assessment and implement appropriate safety measures in accordance with applicable occupational health and safety legislation of South Africa.

The Client must:•    Provide safe roof access•    Disclose fragile surfaces (including skylights or asbestos sheets)•    Ensure structural stability of mounting areas

The Company reserves the right to stop work immediately if conditions are unsafe, including:•    High winds•    Rain•    Storm risk•    Structural instability•    Unsafe anchoring points
Return visits due to unsafe conditions may be chargeable.

5. ELECTRICAL SUPPLY & POWER AVAILABILITYThe Client is responsible for ensuring stable electrical power at the site.If power is unavailable:•    The Company must be informed in advance•    Delays or return visits may be chargeableGenerator costs (hire, fuel, transport, setup) shall be for the Client’s account.

6. COMPLIANCE & CERTIFICATIONElectric fencing installations are completed in accordance with applicable regulations.Where legally required:•    Electric Fence System Certificates will be issued by properly registered personnel.•    Electrical Certificates of Compliance (COC) are not included unless expressly quoted.

7. MANUFACTURER WARRANTIESAll equipment is subject solely to the manufacturer’s warranty.The Company does not provide product warranties beyond workmanship on installation.Labour associated with:•    Fault finding•    Removal•    Reinstallation•    Transport•    Warranty processingIs chargeable regardless of manufacturer approval or rejection.

8. FAULT FINDING & DIAGNOSTICSAll fault finding, testing, diagnostics, and technical assessments are chargeable services unless specifically included in a maintenance plan.The Company is not liable for manufacturer decisions or delays.

9. COSMETIC & INCIDENTAL DAMAGEDue to the nature of installation and technical work, minor cosmetic impact may occur to:•    Walls•    Paint•    Plaster•    Ceilings•    Tiles•    Paving•    Conduits

The Company is not liable for:•    Pre-existing defects•    Hidden services•    Brittle or aged materials•    Structural weaknesses

Unless gross negligence is proven.

10. PAYMENT & OWNERSHIPAll equipment supplied remains the property of the Company until paid in full.Failure to pay may result in:•    Suspension of service•    Suspension of support•    Suspension of warranty assistanceThe Company reserves the right to recover unpaid equipment where legally permissible.

11. NON-PAYMENT & SERVICE SUSPENSIONIf any payment is overdue:•    Maintenance services may be suspended•    Call-out privileges may be withdrawn•    Material inclusions may be forfeitedUntil full payment is received.

12. LIMITATION OF LIABILITYTo the maximum extent permitted by law:The Company’s total liability arising from any claim shall be limited to the total fees paid by the Client in the preceding three (3) months, or the value of the specific job, whichever is lower.The Company shall not be liable for:•    Indirect losses•    Consequential damages•    Loss of profits•    Theft or criminal actsSecurity systems reduce risk but do not guarantee prevention of crime.

13. INDEMNITYThe Client indemnifies and holds harmless the Company against claims arising from:•    Unsafe site conditions•    Animal-related incidents•    Electrical hazards beyond control•    Client tampering or interference•    Structural failure not caused by the Company

The Company processes personal information only for purposes of:•    Service delivery•    Billing•    Communication•    Technical supportInformation is handled in accordance with applicable South African data protection legislation.The Company does not access or store CCTV footage unless required for diagnostic purposes and authorised by the Client.

15. FORCE MAJEUREThe Company shall not be liable for delays or failure caused by:•    Load shedding•    Power outages•    Extreme weather•    Civil unrest•    Supplier delays•    Government restrictions
________________________________________16. GOVERNING LAWThese Terms are governed by the laws of the Republic of South Africa.________________________________________17. SEVERABILITYIf any clause is deemed invalid or unenforceable, the remaining provisions shall remain in full force.
